These Terms of Service ("Terms") govern your access to and use of the KASUPP website, store, and related services (the "Services"), operated by Kasupp LLC. By accessing the Services, browsing our catalog, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the Services.

1. Who may use the Services

You must be at least 18 years old, or the age of majority in your state of residence, to purchase from KASUPP. By placing an order you confirm that you meet this requirement and that the information you provide is accurate and complete. Our products are intended for adults and are sold for personal use, not for resale, unless we have agreed otherwise in writing.

2. Dietary supplements — important notice

KASUPP sells dietary supplements. In the United States, dietary supplements are regulated by the Food and Drug Administration as a category of food, not as drugs. The FDA does not approve dietary supplements for safety or effectiveness before they are sold.

These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

Nothing on the Services is medical advice, and no content on the Services creates a doctor-patient relationship. Product descriptions, articles, guides, and customer care responses are general information only. Consult a qualified healthcare professional before beginning any supplement, particularly if you are pregnant or nursing, under 18, taking prescription or over-the-counter medication, preparing for surgery, or managing a medical condition. Discontinue use and seek medical attention if you experience an adverse reaction.

Always read the label, Supplement Facts panel, ingredient list, allergen statement, and directions before use, and follow the directions on the product you receive. The label on your product controls if it differs from information shown on the Services.

3. Accounts

You may need an account to use some features. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly at customercare@kasupp.com if you believe your account has been used without your authorization. We may suspend or terminate an account that we reasonably believe has been used in violation of these Terms or applicable law.

4. Products, availability, and descriptions

We work to describe our products accurately, including ingredients, serving sizes, and directions. Even so, product formulations, packaging, and labels change from time to time, and we do not warrant that every description, image, or other content is complete, current, or error-free. Product availability is not guaranteed and we may limit quantities, discontinue products, or refuse or cancel any order at our discretion.

5. Pricing, orders, and payment

Prices are shown in U.S. dollars unless checkout states otherwise, and are subject to change without notice. Applicable taxes and any optional shipping charges are calculated and displayed before you submit your order. Placing an order is an offer to purchase; a contract is formed only when we accept the order and dispatch it.

By submitting an order you authorize the stated total and confirm you are permitted to use the payment method. Payment is processed through Shopify's encrypted checkout. If a material pricing or product error affects your order, we may contact you, correct the error, or cancel and refund the affected amount. See our Payment Policy for further detail.

6. Shipping, title, and risk of loss

Shipping timelines, carrier options, and delivery estimates are described in our Shipping Policy, which forms part of these Terms. Carrier estimates are not guaranteed delivery dates. Title and risk of loss pass to you on delivery to the carrier, subject to the assistance we provide for lost or damaged shipments as described in the Shipping Policy.

7. Returns and refunds

Returns are governed by our Refund Policy, which forms part of these Terms. Because our products are consumable and taken internally, opened or unsealed products cannot be returned for safety reasons except where a product is defective or was shipped in error, or where applicable law requires otherwise.

8. Subscriptions

Where a product is offered on a subscription ("Subscribe & Save"), you authorize recurring charges at the frequency and price shown at checkout until you cancel. You may skip a delivery, change the frequency, or cancel at any time from your account or by contacting us. There is no minimum number of orders and no cancellation fee. Changes take effect for orders that have not yet entered fulfillment.

9. Acceptable use

You agree not to use the Services to break the law, infringe anyone's rights, submit false or misleading information, attempt to gain unauthorized access to any system, interfere with the operation or security of the Services, scrape or harvest data, or submit content that is unlawful, defamatory, or deceptive. You may not make claims on our behalf about what our products do.

10. Reviews and submissions

If you submit a review, comment, photo, or other content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and reproduce it in connection with the Services. You are responsible for what you submit and confirm it is your own honest experience. We do not publish fabricated reviews, and we may remove content that is unlawful, off-topic, or that makes disease or treatment claims.

11. Intellectual property

The KASUPP name, wordmark, logos, packaging, site design, text, graphics, and other content are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-transferable licence to access the Services for personal, non-commercial use. No other rights are granted.

12. Third-party services and links

The Services rely on third parties, including Shopify for hosting and payment processing and carriers for delivery, and may link to third-party sites. We are not responsible for third-party content, products, or practices, and your dealings with third parties are between you and them.

13. Disclaimers

Except as expressly stated in these Terms or required by law, the Services and products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, and we do not promise any particular health, fitness, body-composition, or performance outcome from using our products.

14. Limitation of liability

To the maximum extent permitted by law, KASUPP and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or relating to your use of the Services or products. To the maximum extent permitted by law, our total liability for any claim relating to the Services or a product will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify and hold harmless KASUPP and its officers, employees, and suppliers from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

16. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve the matter directly.

17. Changes to these Terms

We may update these Terms from time to time for operational, legal, or regulatory reasons. The revised version will be posted here with an updated "Last updated" date and applies to your use of the Services from that date. Orders are governed by the Terms in effect when the order was placed.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, Shipping Policy, Refund Policy, and Payment Policy, are the entire agreement between you and KASUPP regarding the Services.
